These terms govern your use of elvaryn.travel and every experience you book through us. Booking with Elvaryn means you accept them. Please read section 2 in particular — it explains that Elvaryn sells these experiences directly, and that your contract is with us.
01Agreement to these terms
By using elvaryn.travel (the Site) or booking an experience through it, you agree to these Terms and Conditions, together with our Privacy Policy and Cancellation and Refund Policy. Together these form the agreement between you and Elvaryn LLC.
If you do not accept them, do not use the Site or book with us.
02Who we are and what we sell
Elvaryn LLC is a limited liability company registered in the State of Wyoming, United States. We curate and sell travel experiences — lodging, day visits, guided expeditions and related activities.
We are the seller
Elvaryn is not a listing site, a marketplace, or a booking agent acting for someone else. We acquire the right to offer each experience from the local operator that runs it, we set our own prices independently, and we sell to you in our own name.
Your contract is with Elvaryn LLC. We are the merchant of record. We charge you, we hold the contractual obligation to deliver what you bought, and we handle refunds. You do not enter into a separate contract with the local operator by booking through us.
Local operators are our suppliers. They deliver the experience on our behalf, and we remain responsible to you for it under section 9. Any arrangement between Elvaryn and an operator is a matter between us and them, and does not change what we owe you.
Where experiences take place
Experiences sold by Elvaryn are performed outside the United States, at the destinations described on the Site. The Site, our booking system and our payment processing operate from the United States.
03Definitions
- Elvaryn, we, us, our — Elvaryn LLC, Wyoming, USA.
- You, Guest — the person making a booking, and every person included in it.
- Experience — any lodging, day visit, expedition or activity sold on the Site.
- Booking — a confirmed reservation for an Experience.
- Operator — the local business that performs an Experience on our behalf.
- Lead Guest — the person who makes the Booking and accepts these terms for everyone in the party.
04Who can book
You must be at least 18 years old and legally able to enter into contracts. If your party includes minors, an adult must be the Lead Guest and is responsible for them throughout the Experience.
The Lead Guest accepts these terms on behalf of everyone in the booking and is responsible for the accuracy of the information provided and for payment in full.
05How booking works
Steps
- You select an Experience and enter your details.
- You review the price, the dates and the applicable cancellation window.
- You pay. Payment is processed by Stripe.
- We confirm availability and send you a written confirmation by email.
When your booking becomes binding
Your booking is not confirmed until you receive our written confirmation email. Submitting payment alone does not create a booking.
If we cannot confirm your dates, we will cancel the booking and refund you in full. This is the only circumstance in which we may decline a booking after payment, other than suspected fraud or a breach of these terms.
Your confirmation
Keep your confirmation email. It contains your booking reference, the details of what you bought, the total paid, the cancellation window that applies, and your arrival instructions. Where an Experience carries conditions beyond these terms, they are stated in the confirmation and were disclosed to you before payment.
06Prices and payment
What you see is what you pay
Prices are shown in United States dollars and are the total price for the Experience. We do not add booking fees, service charges or commissions at checkout. Where a tax or government levy applies, it is shown before you pay.
Because we buy and resell rather than take a commission, our margin is already contained in the displayed price. It is not added on top of it.
Payment
We accept major credit and debit cards and the digital wallets offered at checkout. Payment is processed by Stripe, Inc. We do not receive or store your full card number.
If you pay with a card denominated in another currency, your bank sets the exchange rate and may charge a conversion fee. We do not control or receive any part of that fee.
Failed payments
If payment fails, no booking is created and no dates are held. You are welcome to try again or to contact us at bookings@elvaryn.travel.
If you think you were charged incorrectly
Contact us first at bookings@elvaryn.travel with your booking reference. We will investigate and respond within ten business days. Raising a chargeback with your bank before contacting us usually makes the problem slower to resolve, not faster.
07Cancellations and refunds
Cancellations are governed by our Cancellation and Refund Policy, which forms part of these terms. In summary:

If we cancel your Experience, you receive a full refund regardless of timing. The full policy covers force majeure, no-shows and modifications.
08Changes to your experience
Changes you request
Write to bookings@elvaryn.travel with your booking reference. Changes depend on availability. Requests made within the free cancellation window carry no fee; after it, we will do what we can but cannot promise a change, and the no-refund rule still applies if we cannot accommodate you.
Changes we make
Mountain conditions change. We or the Operator may adjust the order of activities, substitute an activity of comparable value, or alter timings for safety or weather reasons. These are normal operational adjustments and do not entitle you to a refund.
If we need to make a material change — a different property, a different date, or the removal of a defining element of the Experience — we will tell you as soon as we can, and you may either accept the change or cancel for a full refund.
09What we are responsible for
Because we sell these Experiences directly, we are accountable to you for them. We are responsible for:
- Delivering the Experience substantially as described at the time you booked.
- Describing Experiences and prices accurately and without misleading you.
- Selecting Operators with reasonable care and requiring them to meet our standards.
- Processing your payment, your cancellation and your refund correctly and on time.
- Responding to problems you raise during or after your Experience.
If something goes wrong, raise it with the Operator on site so it can be fixed while you are there, and tell us at support@elvaryn.travel within ten days of your Experience ending. Reporting a problem promptly is what allows us to resolve it, and prompt reporting will be taken into account when we assess any claim.
10Limits on our liability
Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence, or for fraud.
Subject to that:
- Our total liability for any claim connected to a Booking is capped at the greater of the amount you paid for that Booking or USD 500.
- We are not liable for indirect or consequential loss, loss of profit, loss of enjoyment measured beyond the value of the Experience, or wasted expenditure on travel we did not sell you.
- We are not liable for your own arrangements — flights, connecting transport, accommodation before or after your Experience, visas or insurance — or for losses caused by their failure.
- We are not liable for events beyond our reasonable control, including natural disaster, volcanic or seismic activity, severe weather, epidemic, civil unrest, strike, or government action.
We strongly recommend comprehensive travel insurance covering cancellation, medical treatment, evacuation and personal belongings. We do not sell insurance and cannot advise you on it.
11Risks you accept
Our Experiences take place in mountain and forest environments, at altitude, sometimes far from medical facilities. Some involve hiking, uneven terrain, high altitude, volcanic terrain or overnight exposure to cold.
By booking you acknowledge that these activities carry inherent risk that cannot be eliminated, and that you are choosing to accept it. You confirm that you and everyone in your party are in adequate health for the Experience booked, and you agree to disclose any medical condition, injury, dietary requirement or mobility need that could affect participation or safety, before arrival.
Operators may refuse participation on genuine safety grounds. Where that refusal follows from something you did not disclose, no refund is due.
12Your responsibilities
- Give accurate booking information, and tell us if it changes.
- Hold valid travel documents and meet the entry requirements of the destination country.
- Arrive at the stated place and time. Transport delays are your risk, so plan accordingly.
- Follow safety briefings and reasonable instructions from Operator staff and guides.
- Treat staff, other guests, property and the natural environment with care and respect.
- Supervise any minors in your party at all times.
13Conduct we don't allow
You may not use the Site or attend an Experience to break the law, harass or discriminate against anyone, damage property or the environment, bring weapons or illegal substances, or behave in a way that endangers yourself or others. You may not attempt to interfere with the Site, scrape it, or access it by automated means.
Where conduct of this kind occurs, the Operator or Elvaryn may end your participation immediately. No refund is due in that case, and you remain responsible for any damage caused.
14Reviews and photos
You keep ownership of everything you write and photograph. By submitting a review or image to us, you grant Elvaryn a worldwide, royalty-free, non-exclusive licence to display, reproduce and adapt it for the purpose of promoting Elvaryn and its destinations, in any medium. You may withdraw that licence for future use by writing to support@elvaryn.travel; material already printed or published elsewhere may remain in circulation.
You confirm that the material is your own, that it reflects your genuine experience, and that anyone identifiable in a photograph has agreed to appear.
We may decline or remove submissions that are unlawful, defamatory, off-topic or invasive of someone's privacy. We do not remove reviews because they are critical of us.
15Our content
The text, photography, design, curation and software of elvaryn.travel belong to Elvaryn or are used under licence. You may view the Site and keep a copy of your own booking confirmation. You may not copy, republish or use our content commercially without written permission.
16Indemnity
You agree to reimburse Elvaryn for losses, claims and reasonable legal costs that arise from your breach of these terms, your breach of the law, or damage or injury caused by you or by a member of your party during an Experience.
This does not apply where the loss was caused by our own breach or negligence.
17Suspension and termination
We may suspend or refuse service where a payment is fraudulent, where these terms have been breached, or where there is a genuine safety concern. Where we do so without cause attributable to you, we refund you in full.
You may stop using the Site at any time. Cancelling a confirmed booking is governed by the Cancellation and Refund Policy.
Sections 10, 11, 14, 15, 16 and 18 survive termination.
18Disputes and governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules.
Talk to us first
Before starting legal proceedings, write to support@elvaryn.travel with the subject line "Dispute" and describe the problem and the outcome you want. We will respond within ten business days and will attempt to resolve the matter in good faith for thirty days. Most disputes end here.
If that doesn't resolve it
Either of us may then bring proceedings in the state or federal courts located in Wyoming, and both of us submit to their jurisdiction. Claims must be brought within two years of the events giving rise to them. Claims are brought individually and not as part of a class or representative action.
If you are a consumer resident in a jurisdiction whose law gives you the right to bring proceedings in your local courts, or grants you rights that cannot be contracted out of, this section does not remove those rights.
19Taxes
Where a tax or levy applies to your Experience, it is shown in the price before you pay. Elvaryn is responsible for its own taxes and for collecting and remitting any tax legally due on the sale. You are responsible for currency conversion charges and any bank fees applied by your own payment provider.
20Changes to these terms
We may update these terms. The version in force is the one published here, and the date of the current version is shown at the foot of this page.
The terms that apply to your booking are those in force on the day you booked. Changes we make afterwards do not alter a confirmed booking. Where a change is significant, we will say so on the Site.
21General provisions
If any part of these terms is held unenforceable, the rest continues to apply and that part is read as narrowly as needed to make it valid.
A delay in enforcing a right is not a waiver of it. These terms, with the Privacy Policy and the Cancellation and Refund Policy, are the whole agreement between us for the Experiences we sell you.
These terms are written in English. Any translation is provided for convenience, and the English version governs.
